Brazil’s Supreme Court (STF) spent Tuesday, 3 November 2026, hearing arguments about the national betting ban and then sent everyone home without a ruling. Justice Luiz Fux, the rapporteur, ran a public hearing on Provisional Measure 1.394/2026, the order that banned fixed-odds bets and online casino games. According to Migalhas, the session started at 10:00 and closed at 20:00 Brasília time — about ten hours — and Fux said the hearing was informational and involved no decision. The ban remains in force.
That outcome matches what the court had already framed: a public hearing collects evidence; it does not decide interim relief. We covered the participant list before the day began in our pre-hearing report. Nothing in the STF’s own coverage of the day announced an injunction or a judgment.
What the court says it is hearing
In its opening report and a later afternoon summary, the STF sets out two dockets. ADIs 7721, 7723 and 7749 challenge parts of Law 14.790/2023, the statute that regulated fixed-odds betting. ADIs 8024, 8027, 8028 and 8035 challenge MP 1.394/2026 itself (see chart). Fux recalled the court’s first bets hearing in November 2024 and said this second day was needed after the provisional measure changed the landscape.
Government speakers, including the justice minister and the Attorney General’s office, defended the ban on public-health and family-debt grounds. Football clubs and sports bodies warned about lost sponsorship, short transition times and illegal markets. Those positions are advocacy inside an open case; they are not findings by the court.
Congress still holds the clock
A provisional measure has force at once but lapses unless Congress converts it. The Congress record for MPV 1394/2026, checked on 5 November 2026, still shows the first deliberation window running from 25 September to 23 November 2026, with agenda urgency from 9 November. The mixed committee is still listed as awaiting installation. So the hearing ends with the same two open tracks as before: Fux’s docket, and Congress.

Why it matters for GambleFi
While the ban stands, every licensed fixed-odds operator stays offline in Brazil, and the measure still reaches foreign operators that serve people there — including offshore crypto casinos and iGaming token (GambleFi) platforms with Brazilian users. A later injunction or a Congress lapse could reopen that market; neither happened on 3 November. Earlier coverage: the post-election filings and how prediction markets priced the run-off. Our GambleFi FAQ explains how these platforms work. This is a report on court proceedings, not legal or betting advice.
