On 5 November 2026 the Commodity Futures Trading Commission issued an interpretation of Commission Regulation 38.151(b) — the Impartial Access Requirements for designated contract markets (DCMs). The release and the accompanying interpretive guidance PDF say DCMs must provide competitive, open, fair and impartial access to members and persons with trading privileges. Chairman Michael S. Selig put the geographic point in one line: derivatives markets must operate on a uniform basis at a national scale, and geographic access restrictions are inconsistent with those purposes and the Act’s impartial access requirements.
What the 30-day clock requires
Within 30 days of the 5 November release, DCMs must cease domestic geographic restrictions that violate the Impartial Access Requirements, or submit to the Division of Market Oversight an explanation why compliance is not feasible. Counting that window from the PR date lands on 5 December 2026 as a calendar mark (30 days after 5 November; the Commission stated the clock in days, not a fixed calendar date). In the same 30-day window, DCMs should ensure that intermediaries accessing their markets are not impeding and are complying with the DCM’s Impartial Access Requirements, or else explain why that is not feasible. The Commission says it will consider the facts and circumstances of any particular case for potential Commission action.
Why prediction-market desks care
Event-contract DCMs have been the front line of state-by-state access fights. We tracked the CFTC’s Utah preemption suit, the casino carve-out now in force, and venue-level steps such as Polymarket US halting Michigan sports contracts. This interpretation does not name a state or a product; it restates how Reg 38.151(b) reads for domestic geographic access. Separately, Kalshi’s new single-stock perpetual futures listing shows how fast DCM product calendars can move once CFTC process clears.

Why it matters for GambleFi
iGaming token (GambleFi) users and desks that sit next to CFTC event-contract venues care when access rules change at the exchange layer, even when no token is named. A 30-day impartial-access clock is process, not a product launch. Our GambleFi FAQ covers how these platforms fit together. This is a report on a CFTC interpretation, not legal or trading advice.
