SÃO PAULO — Every fixed-odds betting authorisation in Brazil ends on 25 October 2026, and Stake’s court order to keep operating until then lasted one day. On 8 October the 9th Federal Civil Court of São Paulo partly granted an injunction to Stake Brazil Ltda. On 9 October the president of the Federal Regional Court of the 3rd Region (TRF-3), Judge Johonsom di Salvo, suspended it at the request of the federal government, in case No. 5032238-54.2026.4.03.0000. The suspension holds until a final judgment in Stake’s case or a new decision by the court’s presidency.
What the ban does
Provisional Measure 1.394/2026, published on 25 September, bans the operation, offer, intermediation and advertising of fixed-odds betting in Brazil, covering sports betting and online games, including when offered from abroad to people in Brazil. Article 4 says authorisations granted under Law 14.790/2023 are extinguished 30 days after publication, and that operators have no right to a refund of the licence fee they paid or to compensation. New authorisations are barred. Under the Ministry of Finance’s schedule, no new money could enter betting accounts from 25 September and sites had to be offline from 6 October. Our report on the refund wind-down covers what happened to bettors’ balances. Under the Constitution, a provisional measure takes effect immediately but lapses unless Congress converts it into law within 60 days, extendable once by another 60.
Stake’s case
Stake Brazil held authorisation Portaria SPA/MF 263 of 7 February 2025, with a term to 31 December 2029. In its writ of mandamus (No. 5030862-66.2026.4.03.6100), filed on 5 October, the company says it paid R$30 million for that authorisation. The first-instance decision rejected its main requests, to keep the authorisation until 2029 and to suspend the measure as applied to it. It did order that the authorisation stay in force until 25 October, with conditions: no new promotions or sign-up bonuses, withdrawals and refunds kept open, enough money set aside to pay player balances, and no domains or brands outside the authorisation. The court stressed that its order did not cover operation after 25 October. In the suspension decision, the TRF-3 president found a serious risk to public administrative order: one operator would have stayed authorised while all others were bound by the ban, and the order could encourage similar suits. He also pointed to the constitutional challenges pending at the Supreme Court (STF).
What comes next
The STF docket for ADI 8024, one of those challenges, shows it was registered on 28 September and assigned to Justice Luiz Fux, with filings including a request for interim relief on 5 October. As of 21 October the docket lists no decision. The TRF-3 decision names two more challenges, ADI 8027 and ADI 8028. Unless a court or Congress changes course, the authorisations end on 25 October. Under Portaria SPA 3.005/2026, former licensees have until 15 December 2026 to settle the obligations from their operating period. The chart above shows the timeline.

Why it matters for GambleFi
Brazil’s regulated market, which opened in January 2025, was one that a crypto-casino brand could enter with a local licence, and Stake took one. The measure also covers offers from abroad, which matters for offshore crypto casinos. Semrush’s third-party estimates, cited in our report on Shuffle’s Thailand block, list Brazil among the five largest audiences of Shuffle. As the Shuffle risks page notes, its terms bar users from any jurisdiction that requires a licence Shuffle lacks. This is a report on a court case and a law, not legal or betting advice.
